Instructor: Gregory Miller
Weekly Assignment #4
Due Date: February 10, 2011

In the early years after the ratification of the United States Constitution, the principle of judicial review was established by the Supreme Court of the United States, largely due to the man who served as Chief Justice from 1801 to his death in 1835, John Marshall. Read the two decisions on pages 194-197 of Documents for America’s History (Fletcher v. Peck and McCulloch v. Maryland). What core principle is the Court advocating in these decisions? Are these decisions consistent with this core principle? Are they consistent with each other?
